What is Chapter 13 Bankruptcy?

Chapter 13 Bankruptcy is commonly referred to as the Wage Earner's Plan.  An individual in Chapter 13 makes payments to a Trustee based on that individual's income and expenses.  After completion of payments through the Plan, an individual's debts are then discharged similar to a Chapter 7 Bankruptcy.

How long do I have to make payments in a Chapter 13?

Typical Chapter 13 Plans are between 3-5 years.

Yes.  One of the greatest benefits of Chapter 13 is the automatic stay that lasts throughout the Plan.  As long as the automatic stay is in effect, an individual can avoid foreclosure and make up missed payments or otherwise negotiate with their mortgage company.
